Waiver
I, the above listed Volunteer, desire to work as a volunteer for the International Association of Emergency Managers (IAEM) and engage in the activities related to being a volunteer for a work project.
I hereby voluntarily, execute this Volunteer Waiver under the following terms:
I, the Volunteer, release and hold harmless IAEM and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work with the Organization.
I understand that my time with IAEM at the conference may include various activities that may be strenuous and I hereby expressly and specifically assume the risk of injury or harm in these activities and release IAEM from all liability for injury, illness, death, or property damage resulting from the activities of my time with IAEM.
I grant unto IAEM all right, title, and interest in any and all photographic images and video or audio recordings that are made by IAEM during my work at the IAEM Annual Conference, including, but not limited to, any royalties, proceeds, or other benefits that are derived from such photographs or recordings.
I hereby release IAEM from any claim whatsoever which arises or may arise in the future on account of any first aid treatment or other medical services that are conducted in connection with an emergency during my time with IAEM.
I understand that this Waiver discharges IAEM from any liability or claim that I, the Volunteer, may have against IAEM with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation on the Organization's work site. I also fully understand that the Organization does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.
The International Association of Emergency Managers (herein IAEM) has taken preventative measures to reduce the spread of communicable disease including, but not limited to COVID-19 (“Communicable Disease”) at in person events. However, I acknowledge that IAEM cannot guarantee that I will not be exposed to or contract a Communicable Disease at the Event. Further, due to the nature of the facilities, services and programs offered at this Event, I understand that attending the Event could increase my risk of contracting a Communicable Disease.
I agree to abide by all applicable COVID-19-related requirements, advisories, policies, procedures, and protocols of the hotel, conference/convention center, and IAEM, as well as the CDC, the state in which the event occurs, and any other governmental authority for the duration of my stay.
I understand the risk that I may be exposed to or infected by a Communicable Disease by attending the Event and that such exposure or infection may result in quarantine requirements, serious illness, permanent disability and/or death. I further understand that the risk of becoming exposed to or infected by a Communicable Disease at the Event may result from the actions, omissions or negligence of myself and others, including, but not limited to, IAEM, its officers, employees, contractors, agents, representatives, sponsors, other participants, and any owners and lessors of premises used to conduct the Event (“Releasees”). I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES and assume full responsibility for my participation in the Event.
In consideration of being allowed to participate in the Event, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, acknowledge and agree as follows:
I HEREBY RELEASE, COVENANT NOT TO SUE, DISCHARGE AND HOLD HARMLESS the Releasees, with respect to any and all liabilities, claims, penalties, suits, demands, judgments, costs, interests and expenses (including attorneys’ fees and costs) arising from or relating to the illness, disability or death of myself (or any person who may contract a Communicable Disease, directly or indirectly, from me), as a direct or indirect result, in whole or in part, of a Communicable Disease, to the fullest extent permitted by law.
I, the Volunteer, understand that I expressly waive any such claim for compensation or liability on the part of IAEM beyond what may be offered freely by the representative of IAEM in the event of such injury or medical expense.
I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Colorado in the United States of America, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of Colorado. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
